What: We need to raise $15,000 to pay our attorney Tim Barnes. He is representing homeowners in their case against developers who want to build houses on the now-closed Ahwatukee Lakes Golf Course.
Why: The developers have asked the Arizona Court of Appeals to throw out the protections against development of the Lakes Golf Course. Homeowners won their case in Maricopa County Superior Court last year upholding the land-use protections on the course.
When: The developers have filed their appeal and Barnes has filed his answering brief. The developers have until Feb. 28 to answer Barnes’ brief. The Appeals Court will then decide whether to hear the case. The case could be resolved in a matter of weeks or months or longer.
Who could be affected: The case is about building homes on the Lakes golf course, but similar land-use rules govern the Ahwatukee Country Club Course. If the legal protections on the Lakes course are rejected, the protections at the country club course would be threatened.
In addition, the case is likely to become ruling legal precedent for similar open spaces in Arizona and the nation. The case is important because the case is in the court of appeals and few cases have previously been decided on the legal issues presented.
